What agreements are there in the rental contract of my home?
A rental contract contains the agreements between you and your landlord. For example, how high the rent is. It also contains a description of the house.
Key points in a rental contract
A rental contract for a rental home contains the following points:
your name;
name of the landlord;
the rent, all-in or divided into basic rent and service costs;
the deposit, how high it is;
the address;
a description of the rental house (number of rooms, bathroom, garden);
start date rental contract;
the time and manner in which you pay;
date when the rent goes up;
the rules for residents;
your signature and the landlord's signature.
Rental contract for an independent house (room)
Are you renting a room? Then there may be other agreements about:
the rent, for example how to cancel the rent;
use of shared spaces such as a kitchen or bathroom;
cleaning of shared areas;
furniture if you rent the house with furniture;
pets, whether you are allowed to have them;
privacy, whether the rooms can be closed off;
rules against nuisance;
visitors, whether you may receive visitors and guests.
Oral or written rental contract
A rental contract does not have to be in writing. You can also make agreements with your landlord in a conversation. These agreements are more difficult to prove. It is therefore better to record them on paper.
Are you renting or are you renting out under the Vacancy Act? You then rent a house that is temporarily vacant. For example, because the owner is unable to sell the house. In that case, only a written rental contract applies.
Monthly service costs in the rental contract
Service costs are added to the basic rent. For example, costs for gas, water and electricity. Are the service costs listed separately in the rental contract? Then the height should be clear. It must also be clear what you are paying these costs for.
Maintenance agreements
The lease may also contain other agreements about maintenance. For example, that your landlord does minor and daily maintenance. Sometimes the landlord adds an amount to the service costs for this.
Determining the condition of the home
Record the condition of the house in writing. Do that at the beginning of the rental. At the end of the lease, you must also leave the house as it is.
Different types of rental contracts
Model A - indefinite
Model B - Fixed term, maximum 2 years
Model C - Fixed time, with diplomatic clause
Model D - Temporary
